Accepting these Terms

By creating an account or using Smart Clinical Scribe (the “Service”), you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the Service. The Service includes the Smart Clinical Scribe website and the Smart Clinical Scribe EMR Autofill Chrome extension.

You confirm that you have read and agree to these Terms by ticking the acceptance box when you register.

2

Who can use the Service

Smart Clinical Scribe is for licensed healthcare providers, and for staff, such as medical assistants, who are authorised by a provider to work on that provider's notes and tasks.

You confirm that you hold the licence or authorisation you claim, and that your use of the Service follows the laws and professional rules that apply where you practise. Use the Service only to document visits for patients you are authorised to treat or support.

3

AI-drafted content must be reviewed

Smart Clinical Scribe drafts documentation with AI. A draft is not a medical record until the treating provider has reviewed it and signed it.

Everything the Service produces, including notes, transcripts, translations, suggested ICD-10 and CPT codes, care plans, orders, referral letters and summaries, is a documentation aid only. It is not medical advice and does not replace professional judgment. Smart Clinical Scribe does not practise medicine.

AI can make mistakes. It can mishear or mistranslate speech, leave things out, or include something that was not said. You, the treating provider, are fully responsible for:

  • reading, editing and verifying every AI-generated note before you sign it or place it in any medical record;
  • checking that any suggested billing code is appropriate;
  • every clinical decision made for a patient;
  • meeting your own professional and licensing obligations.
4

Patient information and consent

Visits can include protected health information (PHI) and other sensitive data. You are responsible for using the Service in line with HIPAA and any other privacy law that applies to you and your organisation, for entering patient details only where you are permitted to, and for getting any patient consent the law or your organisation requires, including consent to record a visit.

Our Privacy Policy explains how data is handled. If you need a Business Associate Agreement (BAA), contact us before you use the Service for PHI.

5

Your account

  • Keep your password and sign-in details private, and do not share your account.
  • You are responsible for all activity under your account.
  • Tell us right away if you think someone else has accessed your account.
  • Keep your account details accurate and up to date.
  • Share your staff invite code only with staff you authorise. A provider is responsible for the staff they link to their account.
6

What you must not do

You may not use the Service to:

  • document patients you are not authorised to treat or support;
  • create false or fraudulent billing codes or medical records;
  • break any law, regulation or professional standard;
  • try to reach data or systems you are not authorised to access, including another user's data;
  • upload malicious code, or attack, overload or interfere with the Service;
  • copy, reverse engineer or resell the Service, or give others access to it as your own.
7

Your content and our property

You keep ownership of the notes and other content you create with the Service. You allow us to process that content only to provide the Service to you, including by sending it to the service providers named in our Privacy Policy.

The Service itself, including the software, design and branding, belongs to us and is protected by law. You may use it under these Terms, but it is not sold to you.

8

How the Service is provided

The Service is provided “as is” and “as available”. We work to keep it running, but we cannot promise it will always be available or free of errors, and we may change or pause features. Do not use it in emergencies, and keep your own copy of any record you need, which you can download from Settings.

9

Limits of liability

As far as the law allows, Smart Clinical Scribe and the people who operate it are not liable for indirect, incidental, special or consequential losses, or for losses that come from errors or omissions in AI-generated content, patient harm from relying on it, billing errors or claim denials, or loss of data.

Nothing in these Terms limits any liability that the law does not allow to be limited.

10

Ending your account

You can delete your account at any time from Settings. We may suspend or close an account that breaks these Terms or puts the Service or other people at risk. What happens to your data when an account is deleted is described in our Privacy Policy.

11

Changes to these Terms

We may update these Terms. The date at the top shows when they last changed. For material changes we will also let you know by email or in the app. If you keep using the Service after a change takes effect, you accept the updated Terms.
